Widerspruchsbescheid — the answer to your objection, and the start of the court clock

A Widerspruchsbescheid is the formal written answer to a Widerspruch you filed earlier. It ends the out-of-court stage: the only way to fight on is a lawsuit, and the clock for that starts with this letter.

You objected to an administrative decision, and this letter is the authority's formal answer. It either grants your objection (Abhilfe), partly grants it, or rejects it (zurückgewiesen).

It marks the end of the out-of-court stage. From here, the only way to fight on is a Klage — a lawsuit at the court named in the letter's Rechtsbehelfsbelehrung.

For orientation: the Widerspruch itself, one stage earlier, must be filed within one month of the original decision (VwGO §70). This letter is the reply to that step.

Who sends it

The Widerspruchsstelle of the authority — or of its supervisory authority — that issued the original decision you objected to: a Jobcenter, a Krankenkasse, a city administration, an Ausländerbehörde, and so on.

Authority letterhead, the title 'Widerspruchsbescheid', a recital of your Widerspruch and its date, a decision formula ('Der Widerspruch wird zurückgewiesen'), reasons, a costs decision, and a Rechtsbehelfsbelehrung pointing to a Klage at the Verwaltungsgericht or Sozialgericht.

The deadline

Klage within 1 month of service of the Widerspruchsbescheid (VwGO §74: 'innerhalb eines Monats nach Zustellung des Widerspruchsbescheids'); in social-law matters likewise one month from Bekanntgabe of the Widerspruchsbescheid, three months if notified abroad (SGG §87).

If you do nothing

Once the Klagefrist expires, the original decision — a benefit cut, a fee, a refusal, an obligation — can no longer be challenged in court and stands as decided (VwGO §74, SGG §87).
