A Mahnbescheid is a court payment order: a creditor claims you owe money and has applied to a Mahngericht to collect it. The letter comes from a real court and starts real deadlines.
Here is the key fact: the court does not check whether the claim is justified. It only checks the form of the application. In the words of the Verbraucherzentrale: 'Gerichte prüfen nicht, ob die erhobenen Forderungen überhaupt berechtigt sind.'
That cuts both ways. A completely unfounded claim can arrive as a Mahnbescheid — and it can also move toward enforcement if nothing is done, because the merits are never examined at this stage.
Who sends it
A Mahngericht — a central civil court (Amtsgericht) that runs the automated court dunning procedure for its federal state. It acts on a creditor's application; the official portal of these courts is mahngerichte.de.
Delivered in a yellow envelope (förmliche Zustellung) with the delivery date stamped on it. If you do nothing
After the 2-week period, the creditor can apply for a Vollstreckungsbescheid — an enforcement order matching the Mahnbescheid (ZPO §699). The Mahnbescheid itself warns of exactly this (ZPO §692). Because the merits were never examined, silence lets even an unjustified claim move to enforcement.
How it escalates
- 01The creditor applies for and receives a Vollstreckungsbescheid (ZPO §699).

Does the Mahnbescheid mean a court decided I owe this money?

The case moves to a normal civil lawsuit only if the creditor pursues it. There is no automatic judgment against you.
What if the 2 weeks have already passed?
